Source: Albuquerque Journal, N.迷你倉M.Sept. 07--The Silver Saddle Motel is suing the city of Santa Fe and the New Mexico Department of Transportation for damages from drainage problems the motel says were caused by a construction project on bordering Cerrillos Road.In July, a thunderstorm resulted in water draining from Cerrillos Road onto the Silver Saddle property "in epic proportions" according to the suit."If it were not for the quick response and effort of the owners (and sadly, hotel guests visiting the City of Santa Fe) the Silver Saddle would have been flooded," the suit says.The lawsuit says the issues have decreased the value of the Silver Saddle by $2.5 million."The City of Santa Fe and the State of New Mexico had a duty to maintain Cerrillos Road in such a way to remediate known, dangerous, and damaging conditions, namely the channeling of storm water onto the Premises," the suit says.A city spokesperson said city officials could not be reached for comment Friday afternoon, a local holiday.The stretch of Cerrillos between Cielo Court and Camino Carlos Rey, where Silver Saddle is located, was dug up in 2011 as part of a long-term plan to fix up Santa Fe's busiest thoroughfare.The Silver Saddle lawsuit charges that in 2011 it became apparent that more stormwater than usual was being directed from Cerrillos Road onto the Silver Saddle's property because of "what appeared to be temporary rerouting of drainage caused by the project." The motel property was subjected to flooding, erosion and other damage, the suit says.The Silver Saddle delivered a tort claim notice that year to the city and project contractor AUI, Inc. -- also named as a defendant in the lawsuit -- and in response was provided 儲存ith sandbags, equipment and help building temporary dirt mounds to prevent further problems while the construction was taking place, according to the suit.The aid stopped once the project wrapped up, however, and no efforts have been taken to permanently fix the problem, the suit says.Other nearby properties along Cerrillos have benefited from higher curbs and retaining walls that were built as part of the project, "but for whatever reason, Silver Saddle has been left entirely exposed," the suit adds.The Silver Saddle lawsuit also maintains that:During storms a river forms in the right northbound lane of Cerrillos near the motel, directing surges of stormwater onto the Silver Saddle's property. Also, cars driving through the puddle push water onto roofs, walls, cars and people in the vicinity of the motel.Two small stormwater drains located on the southeast side of Cerrillos from St. Mike's Road to the Silver Saddle have provided "woefully inadequate drainage of stormwater in the northbound lanes closest to the Premises."The impermeable surface of Cerrillos' northbound lane redirects a significant amount of stormwater onto the Silver Saddle property.The construction project caused erosion of the Silver Saddle's gravel parking lot. Also, red clay and sand from the project's landscaping has piled up on the motel's property.The lawsuit says the city and state have ignored Silver Saddle's most recent complaints and concerns.The construction also caused serious disruption to the Silver Saddle's business, the suit says.Copyright: ___ (c)2013 the Albuquerque Journal (Albuquerque, N.M.)
